This petition has been filed seeking to condone the delay of 203 days in filing the above appeal.
2. Mr.C.Kulanthaivel, learned counsel takes notice on behalf of the respondents 1 - 5.
3. Learned counsel for the petitioner submitted that, the 6th respondent remained exparte before the trial court and thereby, notice to the 6th respondent may be dispensed with. An endorsement to the said effect was also made by the learned counsel for the petitioner.
4. In view of the above, notice to the 6th respondent is dispensed with.
5. Heard learned counsel on either side.
6. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this Court is inclined to order this petition.
7. Accordingly this petition is allowed. Registry is directed to number the appeal, if it is otherwise in order and post the matter for admission.
