Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus, directing the 2nd respondent to consider the petitioner's appeal dated 28.7.2025 to cancel the patta issued wrongly in favour of Vijayakumar S/o.Venugopal in Nattam Patta No.835 in KilKollapalli Village, Modikuppam post, Gudiyatham Taluk, For Petitioner :

O R D E R

This writ petition has been filed for issue of a writ of mandamus directing the second respondent to deal with the appeal filed by the petitioner on 28.07.2025 and pass final orders within the time frame fixed by this Court.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents 1 to 3.

3. The case of the petitioner is that the patta stands in his name in Patta No.835. The grievance of the petitioner is that a third party is also claiming the title over the subject property which resulted in the petitioner filing a suit in O.S.No.206 of 2002 on the file of the District Munsif Court, Gudiyatham, seeking declaration and permanent injunction against the third party. The said suit was decreed and the same was also 2/4

confirmed in appeal in A.S.No.32 of 2013 on the file of the Sub-Court, Gudiyatham. Thus, the decree passed by the Civil Court has become final.

4. The petitioner filed an appeal before the second respondent seeking to cancel the patta that stands in the name of the third party, based on the civil Court decree. Since the same was not considered, the present writ petition has been filed before this Court.

5. Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the second respondent to act upon the appeal submitted by the petitioner dated 28.07.2025 on its own merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

The Writ Petition is disposed of with the above directions. There shall be no order as to costs.
