ORDER

The petitioner, who was arrested and remanded to judicial custody on 13.10.2024. The case was taken on the file before the II Additional Special 1/4

Judge NDPS Court Chennai case connected with the C.C.No.124 of 2025 in Crime No.985 of 2024, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner joined hands with other accused and was in possession of 60 grams of methamphetamine which is a commercial quantity. Hence, this case. 3.The learned counsel appearing for the petitioner submitted that even though the case was taken on file there is no progress an the same is pending for the past one year. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the quantity involved in this case is commercial quantity and there are six previous cases pending against the petitioner.

5.The specific case of the prosecution as stated is that the quantity involved in this case is commercial in nature. Therefore, the petitioner has to satisfy the stipulations laid down under Section 37 of NDPS Act and he failed to do so.

6. In view of the above fact that the quantity involved in this case is commercial in nature and the petitioner has also not satisfied the twin conditions laid down under Section 37 of NDPS Act and there are six previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner. This Criminal Original Petition stands dismissed.
