ORDER
The petitioner, who was arrested and remanded to judicial custody on 21.08.2025 for the alleged offence under Sections 123 of BNS Act, 2023 and under Sections 24(1) of Cigarette and other Tobacco Products Act, 2023, on the file of respondent police, seeks bail.
2. The case of the prosecution is that, the petitioner illegally possessed 350 kgs of tobacco products in his house. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submits that the petitioner has been suffering incarceration from 21.08.2025. He also submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner is having 3 previous cases similar in nature. Hence, he vehemently opposed to grant bail to the petitioner.
5. Taking note to the gravity of offence, the investigation is at initial stage, and on considering the bad antecedents, this court is not inclined to grant bail to the petitioner.
