This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 77 63 days in filing the above Criminal Revision Case against the order dated 21.03.2025 passed in C.M.P.No.231 of 2025 on the file of Judicial Magistrate, Sulur.

2. Mr.N.Ponraj, learned counsel for petitioner submitted that since th petitioner's lorry was seized, he was prevented from his livelihood and also due to financial constraints, the petitioner is not able to instruct counsel on record to prefer the above Criminal Revision case and only during month of September 2025, he gave papers to him, as a result of which, there is a delay of 77 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
