This Criminal Original Petition has been filed to quash the charge sheet in C.C.No.13 of 2025 dated 26.11.2024 on the file of the Additional Mahila Court, Villupuram.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the first respondent and perused the materials available on record.
3. The main contention of the petitioner is that other than the defacto complainant all other witnesses are hearsay witnesses and only due to jerk of the train movement, the petitioner touched the de-facto complainant and there is no harassment as alleged by the prosecution.
4. At the outset, this Court is of the view that whether the physical contact amounts to harassment or not is matter of evidence. There are serious allegations made against the petitioner and hence, at this stage, the final report/charge sheet cannot be quashed. Therefore, this Criminal Page Nos.2/4
Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed.
