This application has been filed by the accused herein to condone the delay of 1345 days in filing restoration petition in Cr.R.C.No.737 of 2011, which was dismissed for default on 07.03.2018.

2. Despite the receipt of notice, the respondent remains exparte.

3. Mr.J. Ranjith Kumar, learned representing counsel appearing for the petitioner submits that the petitioner is aged about 72 years old and he is also ready to deposit the cheque amount of Rs.19,925/- before the trial Court in the form of Demand Draft. His counsel who was on record is no more and this fact was not known to him for long time.

4. In the given circumstances, this Criminal Miscellaneous Petition is allowed on the condition that the petitioner shall deposit Rs.19,925/- (Nineteen Thousand Nine Hundred and Twenty Five Rupees Only) in the form of Demand Draft before the Trial Court on or before 22.04.2024, failing which this Criminal Miscellaneous Petition stands dismissed automatically without any further reference to this Court.
