Challenging the order passed by the learned Principal Sessions Judge, Chennai, in Crl.M.P.No.8106 of 2025 dated 02.09.2025, dismissing the petition seeking modification of the condition imposed in Crl.M.P.No.7206 of 2025 dated 05.08.2025, the present Criminal Original Petition has been filed.

It is the contention of the learned counsel appearing for the petitioner that the petitioner, a mother of three minor children, is arrayed as an accused in Crime No.453 of 2025 registered for the offence under Sections 296(b), 329(3), 333, 351(3) and 79 of BNS and Section 4 of TN Prohibition of Harassment of Women Act, 2002. The Principal Sessions Court, Chennai, while granting anticipatory bail to the petitioner in Crl.M.P.No.7206 of 2025 dated 05.08.2025, directed her to stay at Cuddalore and report before the B-1 New Town Police Station, Cuddalore daily at 10.00 a.m., for 30 days. Pursuant to the said order, the petitioner had been duly complying with the conditions. Subsequently, since her son fell ill, she was unable to comply with the conditions and therefore, filed a modification petition. However, the learned Judge, dismissed the same vide order dated 02.09.2025. Hence, the present petition has been filed seeking to set aside the said order.

Learned Government Advocate (Criminal Side), on instructions, submitted that the petitioner had complied with the conditions imposed on her on 05.08.2025 for a period of twelve days. 4.

record.

Considering the nature of the allegations against the petitioner and taking note of the fact that the petitioner has complied with the bail conditions imposed for a period of twelve days, this Court is inclined to modify the condition imposed on the petitioner on 05.08.2025. 6.
Accordingly, the order passed by the learned Principal Sessions Judge, Chennai, in Crl.M.P.No.8106 of 2025 dated 02.09.2025, is set aside. The condition imposed on the petitioner to report before the B-1 New Town Police Station, Cuddalore, is modified to the effect that the petitioner shall appear before the respondent Police everyday at 10.00 a.m., until further orders.

In view of the above, the Criminal Original Petition stands allowed.
