2023-12-01Honourable Mr Justice S.S. Sundar,Honourable Mr Justice Sunder Mohan1 pages

WMP.No.33701/2023 in WP.No.22285/2023 S.S.SUNDAR, J.

AND SUNDER MOHAN, J.

[Order of the Court was made by S.S.SUNDAR, J.,] The above miscellaneous petition has been filed seeking to extend the leave already granted to the detenu/husband of the petitioner herein.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents who strongly opposed this petition being allowed. 3.It is seen that the detenu was earlier granted ordinary leave for 30 days vide order dated 17.10.2023 in WP.No.22285/2023. The fact that the brother of the detenu was also granted leave for similar reason and that the said leave was also extended by this Court and the brother of the detenu was enjoying the privilege for more than 45 days, is not disputed by the learned counsel for the petitioner. In such circumstances, the bona fides of the petitioner's request for extension of leave is doubtful.

4.Having regard to the nature of the offence committed by the detenu for which he is undergoing incarceration, this Court is not inclined to show any indulgence to the detenu who seeks further extension of leave.

5.Hence, this petition stands dismissed.
