ORDER

The petitioner, who is an accused in S.C.No.136 of 2024 pending trail before the learned Judge for IV Additional District Sessions Ponneri Thiruvallur was arrested and remanded to judicial custody on 01.11.2023 for the offence punishable under Sections 302 of I.P.C in Crime No.774 of 2025, registered on the file of the respondent police seeks bail. 2.

The case of the prosecution is that due to previous enmity the petitioner joined hands with other accused and waylaid and assaulted the defacto complainant with deadly weapons. Hence, this case.

3. The learned counsel appearing for the petitioner submitted that co-accused in this case was released on bail and this is the third bail application of the petitioner.

He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case. He further submitted that the petitioner is habitual offender and there are 9 previous cases pending against him 5.Considering the facts, gravity of offence and the bad antecedent of the petitioner, this Court is not inclined to grant bail to the petitioner.
