ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for alleged offences under Sections 302 and 379 of the Indian Penal Code. The incident occurred on 18.06.2012. The brother of the victim is present and he submits that the case can be closed and the accused is not heard of by him. It is represented on behalf of the Police that they have information that the accused has since died, but, his death is never reported anywhere. Be that as it may, since the case is pending from the year 2012 and without any progress, this is a fit case for invocation of the extraordinary power under Article 226 of the Constitution of India. In the event the accused resurfaces or any clue is obtained, liberty is given to the prosecution to reopen the case and conduct the case further. However, it is suspected that the accused has since died.

3. Accordingly, the case in P.R.C.No.2 of 2024 of District Munsif -CumJudicial Magistrate, Thiruvennainallur, Thiruvennainallur Taluk, Villupuram, stands closed. This Suo Motu Transfer Case is disposed of. 14.10.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
