This application has been filed to allow the application to permit the applicant/plaintiff/petitioner to examine Mr.G. Gurumurthy about the Will and to depose that he knows the attesting witnesses and their signature subscribed by them at the foot of the Will.
2. Heard both sides.
3. The learned counsel for the applicant has submitted that they want to examine Mr.G. Gurumurthy to mark the Will.
4. The learned counsel for the respondents has submitted that the applicant has not even completed examination of PW1 and the marking of the Will has to be marked only through PW1 and thus he strongly opposed to allow this application.
5. Having satisfied with the reasons stated in the affidavit filed in support of this application and in the interest of justice, this application is allowed. https://www.mhc.tn.gov.in/judis A.A.NAKKIRAN, J.
gv It is made clear that PW1 has to be examined in full and relevant documents has to be marked through PW1.
6. Post the matter before the learned Additional Master on 05.02.2024 for recording evidence.
