The petitioner seeks for a Mandamus directing the first respondent to consider his representation dated 31.05.2017, wherein and whereby he sought for cancellation of the UDR patta https://hcservices.ecourts.gov.in/hcservices/

granted in favour of the private respondents and consequently to grant the UDR patta in his favour in respect of subject matter referred in the said representation.

2. Heard both sides.

3. The grievance of the petitioner is that the first respondent has not considered the representation so far.

4. The learned counsel for the private respondents contended that the petitioner is not entitled to get such UDR patta.

5. This Court at this stage is not expressing any view on the merits of the claim made by the petitioner as well as the objection raised by private respondents as it is for the first respondent to consider and pass orders on the same, after hearing both parties. As it is stated that the said representation is pending, this Writ Petition is disposed of only with a direction to the first respondent to consider the representation dated 31.05.2017 and pass orders on merits and in accordance with law after hearing the petitioner, the respondents 4 to 8, as well as other private parties, if any. Such exercise shall be done by the first respondent, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
