Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971, to punish the respondents herein for wantonly and willfully disobeying the order of this Court passed in Crl.O.P.No.30800 of 2022 dated 04.07.2023.

ORDER

This Contempt petition has been filed to punish the respondent for his wilful disobedience of the order passed by this Court in Crl.OP No.30800 of 2022 dated 04.07.2023.

2. When the matter was taken up for hearing, 2nd respondent/ contemnor viz., Mr.Vinayagamurthy, Inspector of Police, Arcot Town Police Station, Ranipet District, is present before this Court.

3. The learned Government Advocate (Crl.Side), on instructions, submitted that the investigation was completed and a Closure Report was filed as further action was dropped, before the learned Judicial Magistrate, Arcot, on 26.10.2023. The learned Government Advocate further submitted that when RCS notice was served on the petitioner, it was refused to be received by him.

3. The learned counsel for the petitioner submitted that the petitioner was not aware of the fact that the case itself has been closed and further action has been dropped. He further submitted that RCS notice was never served on the petitioner.

4. Considering the above development, there shall be a direction to the respondents to serve RCS notice to the petitioner in person on or before 22.01.2024. On receipt of the same, it is left open to the petitioner to file a protest petition before the concerned Court.

5. This Contempt Petition is disposed of on the above terms. No costs.
