The learned counsel for the petitioner places reliance on the order of learned Single Judge in Crl.M.P.Nos.10261 and 10263 of 2023 in Crl.O.P.No.11001 of 2023, dated 25.07.2023 with respect to a co-accused whereby, the learned Single Judge of this Court had modified the condition to deposit an amount from Rs.2,00,000/- to Rs.1,00,000/-.

The learned counsel for the petitioner states that this petitioner is also on the same footing and therefore, seeks modification of the condition imposed in Crl.O.P.No.15979 of 2023 by an order dated 31.08.2023, wherein, anticipatory bail was granted by directing the petitioner to deposit a sum of Rs.3,00,000/-. The learned counsel seeks reduction of that amount to Rs.1,00,000/- and claims parity with the other Accused.

3. The learned Government Advocate (Criminal Side) however pointed out that the total amount involved is about Rs.51,00,000/- and the name of the petitioner is also stated by the defacto complainant. But when 1/3

the order had been modified with respect to 1st Accused, it is also appropriate that the other Accused also placed in the same footing.

4. The prosecution may examine the case during the course of trial with respect to the total amount involved and thereafter, orders can be passed. But at this stage, the conditions imposed in Crl.O.P.No.15979 of 2023 by an order dated 31.08.2023 is modified to Rs.1,00,000/- (Rupees One Lakh Only). Accordingly, the time is also extended to produce sureties till 29.12.2023.

5. Accordingly, these Criminal Miscellaneous Petitions are ordered.
