Petition seeking bail in respect of Crime No.1288 of 2024 registered for the alleged offences punishable under Sections 191(2), 191(3), 126, 296(b), 351(3) and Section 25(1A) of Arms Act is on board for consideration.

2. The incarceration of the petitioner/A1 being from 04.11.2024 pleading innocence on the part of the petitioner and false implication in the case, the learned counsel for the petitioner seeks indulgence of this Court. He also submits that the due to previous enmity and in order to keep the petitioner under fetters, the respondent had foisted the present case against the petitioner and others. He also submits that some of the co-accused (A2, A3 & A5) have been granted bail by this Court and the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

3. The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the petitioner/A1 along with other accused waylaid the de facto complainant, abused him in filthy language and also by intimidating him, attempted to assault him with knife. He further submits that 6 previous cases are pending against the petitioner, therefore, if he is released on bail, there is a possibility of him absconding and would threaten the de facto complainant.

4. Having heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record and taking note of the antecedents of the petitioner, this court is not inclined to grant bail to the petitioner.
