Petition seeking bail in respect of Crime No.451 of 2024 registered for the offences punishable under Sections 109(1) & 296(b) of BNS, is on board for consideration.
2. The incarceration of the petitioner being from 06.11.2024 pleading innocence on the part of the petitioner and false implication in the case, the learned counsel for the petitioner seeks indulgence of this Court. He also submits that due to the matrimonial dispute, the de facto complainant has given a false complaint against the petitioner. He also submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.
3. The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that due to certain matrimonial differences between the petitioner and his wife/de facto complainant, the parents of the de facto complainant had supported her daughter and questioned the petitioner, thereby, the petitioner developed a grudge against them and on account of which, on the alleged date of occurrence, the petitioner had gone to the parental house of the de facto complainant, abused the de facto complainants father and attempted to murder him by assaulting with hammer. https://www.mhc.tn.gov.in/judis

4. The learned Government Advocate (Criminal Side further submits that the petitioner was arrested only on 06.11.2024 and the investigation in this case is still pending. He further submits that the injured has been discharged from the hospital, however, if the petitioner is released on bail, there is a possibility of him absconding and would threaten the witnesses.
5. Having heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record and taking note of the fact that the petitioner was arrested very recently and that the investigation in this case is still pending.
