Application No.6142 of 2024 in O.P.No.366 of 2023 Dr.G.JAYACHANDRAN, J.

The application is filed by the mother/Mrs.Vidhya Venkatesh, seeking interim custody of her minor children, namely, Arya Arun Kumar, aged 14 years and Vrishab Arun Kumar, aged 11 years, pending disposal of the original petition.

2. According to the applicant, being the applicant/mother, she pray for interim custody of the children during the half-yearly vacation begins on 21.12.2024 and ends on 05.01.2025. The Learned Counsel appearing for the respondent/father states that the half yearly vacation starts from 21.12.2024 to 05.01.2025. The applicant/mother may have the interim custody of the children for 8 days and for the remaining period, the respondent/father, who is presently taking care and custody of the minor children shall be permitted to take the children outside the jurisdiction of this Court which has been restricted by an earlier order of this Court.

bsm (i) The petitioner/mother, Ms.Vidhya Venkatesh shall have interim custody of the minor children, Arya Arun Kumar and Vrishab Arun Kumar from 21.12.2024 to 28.12.2024. She is permitted to take the children in the place of interest, even if it is outside the jurisdiction of this Court, but not outside the territory of India.

(ii) As far as respondent/father, B.S.Arun Kumar is concerned, the restriction imposed by this Court earlier is relaxed for the period from 29.12.2024 to 05.01.2025. He is permitted to take the children outside the jurisdiction of this Court, but not outside the territory of India.
