ORDER

This Civil Revision Petition has been filed seeking to set aside the order dated 20.08.2024 in M.P.No.2 of 2024 in R.L.T.O.P.No.381 of 2023 on the file of XVI Small Causes Court at Chennai District. 1/4

2.Though the Civil Revision Petition has been filed challenging the order of the trial Court dismissing the application filed to set aside the exparte order, now it is brought to the notice of this Court, in the execution proceeding the revision petition has already filed an undertaking affidavit to vacate the premises on or before 15.02.2025. This Court also verified that the copy of the undertaking affidavit filed by the petitioner herein before the XVI Small Causes Court, Chennai, wherein the revision petitioner undertakes to vacate the suit schedule property and sought time to vacate the premises till 15.02.2025.

3.Learned counsel for the petitioner would submit that the petitioner is ready to vacate the premises as per the undertaking given by him before the trial Court. However, he sought another one month time to vacate the premises i.e till 15.03.2025.

4.In such view of the matter, no further discussion is required in this Civil Revision Petition. The trial Court shall postpone the eviction till 15.03.2025. In the event, the petitioner fails to vacate the premises on or 2/4

before 15.03.2025, he will be proceeded further for contempt proceeding before this Court.
