ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The case was registered in Cr.No.142 of 2013 dated 25.03.2013 for the alleged offence under Section 379 of Indian Penal Code, 1860. The occurrence in this case happened on 24.03.2013. The complainant is present and submits that his two wheeler bearing Registration No. TN-23-BS-3357 has been returned to him. It is stated that the complainant does not wish to pursue the case any further and the case is pending at FS stage. Page No.1 of 3

3. Considering the long pendency, the complainant's stand and the fact that the accused remains untraceable, further continuation would impinge upon the right to a speedy trial. No useful purpose will be served by keeping the matter pending.

4. Accordingly, the case in C.C.No.700113 of 2013 on the file of the Judicial Magistrate No.III Court, Tirupathur Taluk, Tirupathur shall stands quashed and this Suo Motu Transfer Case stands disposed of. 23.09.2025 shl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
