The petitioner, who apprehends arrest at the hands of the respondent police for alleged offences punishable under Sections 303(2) and 326 (a) of BNS, in Crime No.152 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The petitioner is alleged to have transported three units of river sand in his lorry bearing Reg.No.KA-52-B-8432 without permit.

3. The Learned Counsel for the petitioner states that the petitioner is innocent and has not been involved in the alleged offence.

4. On the other hand, the Learned Government Advocate (Crl.Side) for the respondent contends that the petitioner is the owner of the vehicle and he fled from the scene of crime where he was unloading the river sand.

5. Considering the fact that the petitioner has illegally transported three units of river sand without permit and the complainant VAO who had gone to the spot on receiving information of the unloading of the river sand.

6. This Court is of the view that the quantum of river sand illegally transported is high and the anticipatory bail for this crime cannot be granted. 2/4
