The petitioners, who apprehend arrest at the hands of the respondent police for the offence under Section 120B and 420 of IPC, U/s.5 of TN Protection of Interest of Depositors (In Financial Establishment) Act, 1997, U/s.3 & 5 of TN Banning of Unregulated Deposit Schemes Act, 2019 (BUDS Act 2019) in Crime No.3 of 2025, on the file of the respondent police, seek anticipatory bail.

2. The allegation against the petitioner is that the first petitioner (A4). Is the wife of A3. The first petitioner (A3) along with her husband A4 and some other accused persons including second petitioner (A9) induced the defacto complainant to invest money in their companies, namely Sree Sreenivasa Furniture & Metal Mart and Sree Sreenivasa Trading Floor Private Limited (company arrayed as A1 and A2). Pursuant to this, they allegedly collected a total sum of Rs.63,52,526/- from 48 depositors and paid a part amount of Rs.26,63,897/- as profit. However, they subsequently failed to return the remaining balance of Rs.36,88,629/- thereby cheated the defacto complainant. Hence, the case has been registered.
3. The learned counsel for the petitioner submitted that first petitioner (A4) is wife of A3 and second petitioner (A9) is partner to A1 & A2 Company. Apart from that, petitioners are not having any specific overt act against them and also the first petitioner is in the advance stage of pregnancy. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that total amount involved in this case is around Rs.4,86,63,988/- from 48 victims. He further 2/4
submitted that they are not only cheated the defacto complainant and also cheated many persons. He also submitted that no previous case has been registered against them and the allegation against the petitioners is that the first petitioner is the wife of A3 and she along with A9 jointly received a total sum of Rs.4,86,63,988/- and cheated the defacto complainant. Hence, he opposed to grant anticipatory bail to the petitioners.
5. I have heard the submissions made by both sides and also gone through the FIR.

In the FIR, it reveals that huge amount has been involved in this case and that the petitioners herein are not at all partners in the said business but they actually participated in looting huge amount from the depositors. The specific allegation as far as second petitioner (A9) is concerned, he received one Crore from some of the victims. Further, A1 was arrested and still in custody and that investigation in this case is pending and so far no amount has been recovered.
7. Considering the facts and circumstances of the case, taking note of the submission made by the learned Government Advocate (Crl.Side), A1 was 3/4

ssi arrested and no amount is recovered so far and also the fact that the petitioners jointly cheated huge amount from several victims, though it is stated that the first petitioner is in advance stage of pregnancy, investigation in this case is still pending, this Court is not inclined to grant anticipatory bail to the petitioners.
