O R D E R
The petitioner has filed this petition to direct the first respondent to cancel the settlement deed executed by the petitioner in favour of Mr.Ramadurai due to the breach of trust vide Document No.1877/2006 dated 13.04.2006, on the file of S.R.O., Cheiyar as per the Senior Citizen Act 2017 and return the property to the petitioner.

The case of the petitioner is that the petitioner is an 86-year-old unmarried senior citizen residing in Pellandhu Thangai Village, Tiruvannamalai District, executed a settlement deed in favour of Mr. Ramadurai, trusting his promise to take care of him. However, after execution of the deed (Document No. 1877/2006 dated 13.04.2006, registered at SRO, Cheiyar), Mr. Ramadurai allegedly neglected the petitioner, failing to provide food or medical care. The petitioner submitted representations to the District Collector on 21.07.2023 and to the Sub Collector on 15.09.2023, followed by an enquiry on 25.08.2023, where he deposed. Despite this, no action was taken under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. Aggrieved by the inaction, the petitioner has filed this writ petition seeking a direction to cancel the said settlement deed and restore the property to him.
3. Though many grounds have been raised in this writ petition, learned Page No.2 of 5
counsel for the petitioner submitted that it would suffice if this Court issues direction to the first respondent to consider the petitioner's representation dated 19.07.2023 on merits, in accordance with law, within a time frame to be fixed by this Court.
4. Learned Government Advocate appearing for the respondents 1 & 2 would submit that the second respondent has already initiated the enquiry proceeding and fixed the date of enquiry on 28.04.2025 at the office of the second respondent.
5. Heard the learned counsel on either side and perused the materials available on record.
6. Considering the submission made by the learned Government Advocate appearing for the respondents 1 & 2, the petitioner as well as the respondents 3 to 5 are directed to appear in person before the second respondent on 28.04.2025, for the enquiry and after the completion of the said enquiry, the second respondent is directed to pass appropriate orders on merits, in accordance with, within a period of two months thereof.
