G.Ambikesh PRAYER in C.R.P.No.5012 of 2024: Civil Revision Petition filed under Article 227 of the Constitution of India, to strike off the petition in D.V.A.No.89/2022 now pending on the file of Special Court for trial for domestic Violence Act cases, Coimbatore.
Prayer in H.M.O.P.No.277 of 2024: Petition under Section 12 (1)(c) of the Hindu Marriage Act, 1955, to declare the marriage that took place between the petitioner and the respondent on 08.12.2021 at Annamaiyah Midland Residency, Telungupalayam pirivu, Perur Main Road, Coimbatore, on the ground of nullity. Prayer in M.C.No.48 of 2024 : Petition filed under Section 125 of Criminal Procedure Code, directing the respondent to pay a monthly maintenance of Rs.50,000/- to the petitioner and for costs.

Mr.V.Janarthanan COMMON ORDER Pursuant to the order dated 11.06.2025, the parties have appeared before the Mediation Centre and they have been successful in amicably resolving all the disputes by settlement agreement dated 11.07.2025, which has also been reached and executed by the parties. The said settlement agreement is not only signed by the parties but also by their respective counsel.
2. By subsequent order dated 17.07.2025, HMOP No.277 of 2024, pending on the file of Family Court, Coimbatore and M.C.No.48 of 2024 pending on the file of Additional Family Court, Coimbatore were suo motu transferred to this Court to enable this Court to record the settlement arrived at between the parties in this revision.

In compliance of the direction of this Court dated 17.07.2025, the records in HMOP No.277 of 2024 and M.C.No.48 of 2024 have also been transmitted by the respective Courts and the same have been placed before this Court for the effective disposal of the said cases along with the present revision. The parties are also present along with their respective counsel in terms of settlement agreement.
4. It is seen that the payment agreed to be made by the husband has also been settled and the receipt of which also is acknowledged by the wife, who is present in Court today.
5. I confirmed with the first petitioner and the respondent in the Civil Revision Petition and they also agreed that the marriage between them may be declared as null and void and the wife also agreed for striking off the proceedings initiated by her under the Domestic Violence Act, and also to withdraw the maintenance case filed by her, in view of the settlement reached between them.
6. In the light of the above, recording the said settlement agreement dated 5/8
11.07.2025, this Civil Revision Petition is allowed. Consequently, D.V.A.No.89 of 2022, pending on the file of Special Court for Trial of Domestic Violence Act cases, Coimbatore, is struck off. H.M.O.P.No.277 of 2024 filed by the husband is allowed, thereby declaring the marriage solemnized between the first petitioner/husband and the respondent/wife on 08.12.2021 is null and void. M.C.No.48 of 2024 filed by the wife is dismissed. The settlement agreement dated 11.07.2025 shall form a part and parcel of this order. No costs. Consequently, connected Miscellaneous Petition is closed.
