Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Mandamus, directing the First Respondent to take appropriate proceedings against the Fourth Respondent to recover the interest amount payable as per the Recovery Certificate dated 23.02.2017 in D 1/4198/2016 issued by the Second Respondent in respect of the order passed in P.G. Application No. 221 of 2012, under Section 8 of Payment of Gratuity Act, 1972 within the time frame.

Heard Mr. T.Ramkumar, Learned Counsel for the Petitioner, Mr. S.Balamurugan, Learned Government Advocate appearing for the First to Third Respondents and Mr. V.Venkadasalam, Learned Counsel appearing for the Fourth Respondent and perused the materials placed on record, apart from the pleadings of the parties.

The Writ Petition had been filed for directing the First Respondent to take appropriate proceedings against the Fourth Respondent to recover the interest amount payable as per the Recovery Certificate No. D1/4198/2016 dated 23.02.2017 issued by the Second Respondent in respect of the order passed in P.G. Application No. 221 of 2012 under Section 8 of Payment of Gratuity Act, 1972, within the time frame fixed by the Court. 3.

It is represented by Learned Counsel appearing for both sides that a sum of Rs. 1,40,357/- was payable by the Fourth Respondent to the Petitioner in terms of the order passed by the Second Respondent and after adjusting the payments of Rs.1,02,227/- and Rs.31,507/- on 12.10.2015 and 18.04.2016 respectively, the balance amount of Rs.6,623/- has been paid today by way of Cheque No. 147074 dated 15.03.2022 drawn on Canara Bank, Padalam and the receipt of the same is acknowledged by the Petitioner in full satisfaction of his claim. It is informed by Learned Counsel for the Petitioner that the Petitioner would execute receipts for the payments received and that no further amounts are due from the Fourth Respondent and he has made an endorsement to that effect in the court record.
