This Civil Miscellaneous Petition has been filed to condone the delay of 1254 days in representing the above Civil Miscellaneous appeal.

2. Heard the learned counsel for the petitioner.

3.Despite the receipt of notice, respondents no.1 and 2 neither appeared nor entered appearance through their counsel.

4. The petitioner would aver that due to financial constraints and he is not in a position to pay the court fee of Rs.15,300/-. Hence, delay of 1254 days occurred in representing the above appeal.

5. Accepting the averments made in the affidavit filed in support of this petition, this petition is ordered and the delay of 1254 days is hereby condoned.
