This application is listed today at the instance of the learned counsel appearing for the applicant for clarificateion.

2. As the defendant has already been set exparte, notice need not be issued to the defendant.

3. Hence, instead of the following sentence in the fourth paragraph of the Order made by this Court in A.No.6487 of 2023 in C.S.No.185 of 2023, dated 12.12.2023 :

"The Advocate Commissioner shall issue notice to both sides before recording evidence of the applicant / plaintiff." the following shall be incorporated in the Order : "The Advocate Commissioner shall examine the plaintiff in the official residence of the plaintiff. Since the defendant has already been set exparte, the Advocate Commissioner need not issue notice to the defendant."

4. After paragraph fourth paragraph in the above Order, the following paragraph shall be incorporated :

"The registry is directed to hand over all the original documents to the Advocate Commissioner for examination of the https://www.mhc.tn.gov.in/judis witness."

5. The registry is directed to incorporate the above paragraphs and correct the paragraph numbers, issue fresh Commissioner Warrant to the Advocate Commissioner.
