PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the 3rd respondent to offer the post of BT Assistant in one of the Schools in the city of Chennai based on the Teacher Eligibility Certificate dated 28.02.2017 for the vacancy which was available during the academic year 2019-2020 or 2020-2021 without insisting on a pass in 1/5

the competitive exam notified by the 3rd respondent by Notification No.03/2023, dated 25.10.2023.

ORDER

Heard Mrs.Nalini Chidambaram, learned counsel for the petitioner and Mr.M.Bindran, learned Additional Government Pleader for the respondents 1 and 2 and Mr.R.Neelakandan, learned Additional Advocate General for the third respondent. With the consent of both sides, the main writ petition is taken up for final disposal at the admission stage itself.

2. When the petitioner's on-line application made pursuant to the Notification No.03/2023, dated 25.10.2023 issued by the third respondent herein, could not be uploaded in the on-line portal of the third respondent, the present writ petition has been filed.

Today, when the matter was called, the learned Additional Advocate General, on written instructions, submitted that there was an error in uploading the petitioner's certificates and thereafter, they have also rectified the error in the on-line portal. With such submission, learned Additional Advocate General stated that the petitioner can now apply for the said post by today.

4. In view of the above submission, the grievance of the petitioner has been redressed and therefore, no further orders are required to be passed in this writ petition. The petitioner is granted liberty to upload her application in the on-line portal of the third respondent herein and the third respondent shall ensure that the petitioner's application is accepted by them and subject the application to further selection process.

5. With the above observation, the writ petition is closed. No costs. Consequently, connected miscellaneous petition is closed. 12.12.2023 Index:Yes Internet:Yes 3/5
