PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the third respondent to assign regular number to the sale deed dated 27.7.2009 executed in favour of the petitioner in pending Doc.No.225 of 2009 on the file of the third respondent and to release the same based on the representation dated 20.5.2017. ORDER
I have heard Mr.Vimal B.Crimson, learned counsel for the petitioner and Mr.P.P.Purushothaman, learned Government Advocate appearing for the respondents.
2. The petitioner seeks a direction to the third respondent to register and release the sale deed dated 27.7.2009 executed in favour of the petitioner and kept as a pending document bearing doc.No.225 of 2009 by considering the petitioner's representation dated 20.5.2017.
3. The learned counsel for the petitioner fairly submits that in W.P.No. 18680 of 2009 filed by M/s.Alwarpet Benefit Fund Limited wherein the petitioner herein was impleaded as the 11th https://hcservices.ecourts.gov.in/hcservices/
respondent, the relief sought for was to forbear respondents 1 and 3 herein from registering and releasing the sale deeds executed in favour of the private respondents including the petitioner herein.
4. The said writ petition was dismissed by order dated 06.11.2019 on the ground that the prayer sought for had become infructuous. In the said writ petition, the learned Special Government Pleader filed the status report of the Deputy Superintendent of Police, Economic Offences Wing-II, Chennai that a case in Cr.No.993 of 1999 has been registered for the offences under Sections 406, 409, 420, 506(ii) read with 120(b) of the Indian Penal Code and that the same is pending. Hence, the document, which was stated to be registered in favour of the petitioner, cannot be released till the disposal of the said criminal case.
5. In the light of the above, the above writ petition is disposed of leaving it open to the petitioner to work out his remedies after the disposal of the pending criminal case. No costs.
