This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 304 days in filing the above Criminal Revision Case against the order dated 12.08.2024 passed in Crl.M.P.No.37731 of 2024 in on the file of Metropolitan Magistrate for Exclusive trial of CCB cases (Relating to cheating cases in Chennai) and CBCID Metro Cases, Egmore, Chennai.

2. Mr.P.T.Perumal, learned counsel for petitioner submitted that due to lack of legal knowledge and also on receipt of notice only, he came to know about the order passed by the trial court. Hence, the petitioner is not able to instruct counsel on record to prefer the above Criminal Revision case and only during month of September 2025, he gave papers to him, as a result of which, there is a delay of 304 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
