ORDER

This application has been filed to amend the petition particulars mentioned herewith in the above Original Petition.

2. According to the applicant, he is the petitioner in the main petition, he filed the said petition for issuance of Succession Certificate. At the time of __________Page 1 of 4

filing a main petition, he produced depositors receipts and evidence was also recorded. In the meantime, on 24.07.2025, he also recovered some more fixed deposits particulars stands in the name of his father and therefore, those depositors receipts have to be included in the description of property. Therefore, filed this application.

3. However, the respondents filed a counter denying the averments made in the affidavit. The petitioner has not stated any sufficient reasons to allow this application and already evidence was recorded in this case and therefore, at this stage, the petitioner has not stated any reasons to file this application, therefore, this petition is liable to be dismissed.

4. Heard both sides and perused the material records.

5. The petitioner filed an application to include the depositors receipts in the description of property. According to the petitioner, already he filed a petition in respect of some depositors receipts and the case is posted for trial and the evidence was also recorded. At that stage now, he found some other depositors receipts in the name of his father and therefore, filed this application.

6. The respondents filed a formal counter, objecting to all averments of this application.

7. Considering the above said reasons stated by the petitioner that after recording of evidence, he found some depositors receipts in the name of his father, to give fair chance to him and also to avoid the multiplicity of proceedings and to get a binding decree in respect of all the properties, it is appropriate to allow this application.

8. This Application stands allowed accordingly.
