The petitioner/A3 in Crime No.29 of 2023 registered by the respondent police for the offences punishable under Section 420 of IPC seeks anticipatory bail.

2. It is the case of the prosecution that the the other accused were running Deepavali chit funds in the name of Annai Educational and Women Development Foundation Trust . It is stated that from about 450 members total of Rs.76,30,500/- had been collected and the amount had not been returned.

3. Learned counsel for the petitioner stated that the other accused had been granted bail under Section 167(2) Cr.P.C. So far as this petitioner is concerned, it is stated that he had received a sum of Rs.10,00,000/- from the first accused apart from gold coins. The allegations being direct. There are nearly 450 individuals who had 1/3

suffered by their hard earned money disappearing into thin air by the collections made by the accused.

4. Taking all factors into consideration, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. Vv 05.03.2024 2/3
