Original Application filed under Order XIV Rule 8 of Original Side Rules read with Section 9 (1)(ii)(e) of the Arbitration and Conciliation Act, 1996 to pass an order of interim injunction restraining the respondent, its employees, men, servants, agents, representatives or any other person claiming through the Respondent from in any manner interfering in the affairs of the Fresh Sourcing LLP including operating or restricting the bank account No.409840083578 maintained at RBL Bank Ltd., Nungambakkam Branch until the disposal of this matter by an Arbitration Tribunal.

ORDER

This application has been filed under Section 9 of Arbitration and Conciliation Act, 1996 (Act 26 of 1996) [for the sake of brevity "the Act"] seeking interim injunction restraining the respondent from interfering with the affairs of the firm and from operating Bank account till the disposal of the matter by the Arbitral Tribunal.

2. The dispute in this case is between the designated partners of a limited liability partnership. A detailed counter affidavit has been filed in both the applications.

3. This Court heard the learned counsel for the applicant and the learned counsel for the respondent.

4. Considering the nature of dispute between the parties and considering the fact that already the trigger notice dated 23.09.2025 has been issued by the applicant under Section 21 of the Act by invoking Clause 38 of the agreement and both sides consented for appointment of Arbitrator by this Court, this Court deems it fit to appointment an Arbitrator and leave the parties to agitate the dispute before the sole Arbitrator.

In view of the above, Hon'ble Mr.Justice R.Subramaniam (Retd.,), a former Judge of Madras High Court, residing at No.6/29, Flat No.1B, Vishwanath Apartments, 5th Main Road, RA Puram, Chennai - 600 028 [Mob: 98402 99941] is appointed as the sole Arbitrator and Hon'ble Arbitrator is requested to adjudicate the arbitral disputes that had arisen between the parties and render arbitral award by holding sittings in the 'Madras High Court Arbitration Centre under the aegis of this Court' (MHCAC) as per Madras High Court Arbitration Proceedings Rules 2017 and fee of Hon'ble sole Arbitrator shall be in accordance with the Madras High Court Arbitration Centre (MHCAC) (Administrative Cost and Arbitrator's Fees) Rules 2017.

6. It is left open to the parties to move applications under Section 17 of the Act, if so advised and the same will be considered on its own merits and in accordance with law.

7. This application is disposed of with the above terms. There shall be no order as to costs.
