The Criminal Original Petition has been filed seeking to modify the condition imposed on the petitioner by the Metropolitan Magistrate Court (for exclusive trial of Cases registered and investigated by CCB Greater Chennai Police), Egmore, Chennai, on 10.07.2025 in Crl.M.P.No.8499 of 2025 in C.C.No.1084 of 2020. The contention of the petitioner is that the petitioner is an accused in C.C.No.1084 of 2020 for the offences under Sections 120B, 465, 467, 468, 471, 474 and 420 IPC. The petitioner filed an application in Crl.M.P.No.8499 of 2025 before the learned Additional Metropolitan Magistrate for exclusive trial of CCB Cases, Egmore, Chennai, seeking permission to renew his passport bearing No.C5408218 for a period of three years. The learned Magistrate, while allowing the petition on 10.07.2025, directed the Passport Authority to renew the petitioner's passport only for a period of two years. Hence, the present petition has been filed seeking to modify the said condition.

Heard both sides and perused the materials available on record.

In view of the above, this Court is of the opinion that the condition restricting the renewal of the passport for a period of two years is not proper and it is only for the Passport Authority to renew the same in accordance with the applicable rules. Therefore, the condition 3 (i) imposed by the learned Magistrate in Crl.M.P.No.8499 of 2025 in C.C.No.1084 of 2020 dated 10.07.2025, directing the Passport Authority to renew the passport bearing No.C5408218 for a period of two years, is set aside. The Passport Authority is directed to renew the petitioner's passport bearing No.C5408218 strictly as per rules.

Accordingly, this Criminal Original Petition stands disposed of with the above directions.
