O R D E R

This Criminal Original Petition has been filed to direct the third respondent herein remove the petitioner's name in the History Sheet opened by the fourth respondent pursuant to the representation dated 02.03.2019.

2.The learned counsel for the petitioner submitted that the petitioner is practising as an Advocate. For the purpose of helping poor people, he started an organization by name 'Makkal Matrum Satta Pathugappu Eyakkam' and dong free legal services awareness camps. With the view to curtail the petitioner's social activities, the 4th respondent has registered false cases and also opened a history sheet. Therefore, the petitioner has made a representation to the respondent on 02.03.2019 to remove the name of the petitioner from the history sheet.

3.The learned Additional Public Prosecutor has submitted that four cases registered against the petitioner and in one case a final report has been filed and in the other cases, investigation is still pending.

4.This Court has carefully considered the submissions made on either side and also the materials available on record.

5.Taking into consideration the facts and circumstances of the case, there shall be a direction to the respondent police to consider the representation dated 02.03.2019 made by the petitioner to remove the name of the petitioner from the history sheet and deal with the same in accordance with the guidelines given by this Court in the case of Sabari @ Sabarigiri vs. Assistant Commissioner of Police, Annanagar (L and O) Range, Madurai City, Madurai and others reported in (2018) 4 MLJ (Crl.) 585. This process shall be completed by the respondent police within a period of six weeks from the date of receipt of a copy of this order.

6.This Criminal Original Petition is disposed of with the above direction.
