ORDER

This Writ Petition has been filed the 3rd respondent dated 21.06.2017 and quash the same as illegal incompetent and without jurisdiction and consequently direct the 3rd respondent to process the application for planning approval dated 18.05.2017.

2. The case of the petitioner is that the petitioner is the owner of the property situated at Plot No.76, 4th Street, Poombugar Nagar, Kolathur, Chennai and the patta also stands in his name. While so, the petitioner presented an application before the 3rd respondent for getting planning permit for construction of residential unit in the aforesaid property on 18.05.2017 and the same was rejected vide order dated 18.05.2017, on the ground that the boundary is not tallied with the revenue records. The said order is impugned in this writ petition.

3. Though this Writ Petition has been filed for the larger relief, the learned counsel appearing for the petitioner would submit that it would suffice, if the petitioner is permitted to resubmit the application for planning permit with

correct details before the 3rd respondent and the said authority may be directed to consider the same.

4. The learned counsel for the respondents has no objection for such an order being passed by this Court.

5. In view of the limited scope of relief now sought for by the petitioner, without going into the merits of the case and without interfering with the order impugned herein, this Court directs the petitioner to resubmit the application for building permit before the 3rd respondent, within a period of two weeks from the date of receipt of a copy of this order and on such application being filed, the 3rd respondent is directed to pass orders on the same, on merits and in accordance with law, within a period of two weeks thereafter.

6. This Writ Petition is disposed of accordingly. No costs. Consequently, connected Miscellaneous Petition is closed.
