These Civil Miscellaneous Petitions are filed to (i) condone the delay of 450 days seeking to set aside the abatement caused due to the death of the 2nd respondent in the above Second Appeal (ii) set aside the abatement of the suit caused due to the death of the second respondent, and (iii) bring on record respondents 6 to 9 as the legal heir of the deceased second respondent namely Mariasusai.
2. Heard the learned counsel for the petitioner and the learned counsel for the respondents who submits that he has got no serious objection in allowing this petition.
3. Taking into consideration the reasons stated in the supporting affidavit and the legal heirship certificate produced, this Court is satisfied that sufficient cause has been made out for condoning the delay and that the proposed parties are the legal heirs of the deceased second respondent.

dpq respondents 6 to 9 namely, Selvamary, Oliver, Robinson & Sharmilio Daisy Rani are impleaded as the legal heir of the deceased second respondent.
5. These Civil Miscellaneous Petitions are allowed. No costs. Registry to carry out the necessary amendments and list the matter on 28.01.2025 under the caption for " final hearing".
