Respondents Prayer :- Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to grant the tax receipt to the petitioner for the payments of land tax receipt to the petitioner for the payments of land tax for 2.50 acres in S.No.174/1, 175/1 New S.No.174/1L1, 175/1G in Enjembakkam Village, Sholinganallur, Kancheepura District.

ORDER

This writ petition is filed seeking direction to the respondents to grant the tax receipt to the petitioner for the payments of land tax receipt to the petitioner for the payments of land tax for 2.50 acres in S.No.174/1, 175/1 New S.No.174/1L1, 175/1G in Enjembakkam Village, Sholinganallur, Kancheepura District.

2. The case of the petitioner is that the petitioner is the owner of the land in S.No.174 and 175 situated at Enjambakkam, Sholinganallur, Kancheepuram District. The petitioner had obtained patta No.6344 for the above said properties and he is in possession and enjoyment of the same. The petitioner has paid kist to the Village Administrative Officer, Enjambkkam and demanded the receipt for the payments. But the proper receipt was not issued to the petitioner. Hence, the petitioner made a representation to the respondents to grant the tax receipt and they have not furnished the said receipt so far. Hence, the present writ petition has been filed before this Court seeking appropriate remedy.

3. The learned counsel for the petitioner submitted that this court may issue a suitable direction to the respondents to consider the petitioner's representation dated 08.11.2017 and take necessary steps within the stipulated period as fixed by this Court.

4. Heard, the learned counsel for the petitioner as well as the learned counsel appearing for the Government and perused the materials available on record.

5. Considering the facts and circumstances of the case and considering the limited relief sought for by the petitioner, this Court, without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 08.11.2017 and pass appropriate orders on merits and in accordance with law, if the land tax has paid by the petitioner, within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the aforesaid direction, this Writ Petition stands disposed of. No costs.
