J U D G M E N T

(Judgment of the Court was delivered by R.SUBRAMANIAN, J.) By a notice dated 01.01.2024, the appellant was asked to show cause as to why the action should not be taken to cancel the allotment for breach of the conditions. The Writ Court has dismissed the Writ Petition on the ground that a show cause notice cannot be put in issue under Article 226 of the Constitution of India.

2. The learned counsel appearing for the appellant would however invite us to certain documents issued after the filing of the Writ Petition and claimed that the show cause notice itself has become a redundant. It is open to the appellant to take advantage of those documents and file its reply before the respondent. The respondent will consider the same as per law. 2/4

3. The Writ Appeal is dismissed with the above observation. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
