PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus to direct the respondents to appoint the petitioner in any of the post in the respondent department according to her educational qualification under compassionate appointment by considering her representation dated 13.09.2024. ORDER
This writ petition has been filed to direct the respondents to appoint the petitioner in any of the post in the respondent department according to her educational qualification under compassionate appointment by considering the petitioner's representation dated 13.09.2024 .
2. Learned counsel for the petitioner would submit that the petitioner's husband was worked in the respondents' department as wireman. During the heavy rainy season, her husband was indulged in his official work to give electricity connection. He climbed the electric pole and got electrocuted and died on 01.04.2024. The petitioner and his 2 years old son and her mother-in-law are his legal heirs. Hence, the petitioner submitted her application dated 13.09.2024 to the 4th respondent for compassionate appointment along with necessary Page No:2/5
documents. The 4th respondent forwarded the same to the 3rd respondent and the 3rd respondent forwarded the same to the 2nd respondent for necessary action, but no order has been passed by the respondents authorities. He further submitted that the petitioner's husband is the only breadwinner of the family and hence, the petitioner may be appointed in any of the post in the respondent department according to her educational qualification.
3. Learned Standing Counsel appearing for the respondents would submit that the petitioner's representation dated 13.09.2024 will be considered by the respondents on its own merits and in accordance with law, within the time fixed by this Court.
4. In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to direct the respondents to consider the petitioner's representation dated 13.09.2024 and pass final orders on its own merits and in accordance with law, within a period of twelve(12) weeks from the date of receipt of copy of this order.
5. With the above direction, the Writ Petition stands disposed of. No costs.
