Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents 1 to 8 to remove the encroachment made by the 9th respondent in Natham Survey No.589/11 measuring to an extent of 01.72 Ares (1851.39 Sq.ft.,) situated at Kattu Edaiyar Village, Ulundurpet Taluk, For the Petitioner : Mr.N.Subramaniyan For the Respondents : Mr.P.Muthukumar State Government Pleader for R1 to R8
ORDER
(Made by the Hon'ble Chief Justice) Heard Mr.N.Subramaniyan, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader for respondents 1 to 8.
2. Learned counsel for the petitioner submits that encroachment is proved and even an order under Section 6 of the Tamil Nadu Land Encroachment Act, 1905 has been passed. However, no further steps are undertaken by the authorities for removal of the encroachment.
3. Learned State Government Pleader submits that 16.11.2023 was the date fixed for removal of the encroachment. However, due to administrative reasons, the encroachment could not be removed. Learned State Government Pleader further submits that steps would be taken for removal of the encroachment within a period of two months from today in pursuance to the order under Section 6 of the Tamil Nadu Land Encroachment Act, 1905, provided there is no interim order of stay granted by any competent forum.
4. In view of the said submissions, the writ petition, as such, stands disposed of. There will be no order as to costs. (S.V.G., CJ.) (D.B.C., J.) 07.12.2023 Index :
