The petitioner/A-3, who was arrested and remanded to judicial custody on 27.06.2023, registered by the respondent Police for the offences under Section 8(C) read with 20(b)(ii)(C), 25, 29(1), 120(B) of NDPS Act, in Crime No.442 of 2023, seeks bail.

2. It is s stated that the accused Nos. 1 to 3 had been remanded to judicial custody on 27.06.2023 with possession of 120 kgs of Ganja.

3. The learned counsel for the petitioner would submit that this petitioner/A-3 had been involved in the offence only on the confession of the accused Nos. 1 and 2.

4. However, counter has been filed wherein it had been stated that the accused Nos. 1 to 3 had been arrested at the same time when they were standing near vehicle bearing Registration No. TN-14 S 2540. It is stated that subsequently, on confession of A-1, the role of the accused No.4, Selvakuamr came to be known.

5. In view of the fact that the quantity of Ganja seized is commercial quantity, at this stage, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. 04.01.2024 vsg https://www.mhc.tn.gov.in/judis
