O R D E R
This Contempt Petition has been filed complaining wilful disobedience of the order dated 18.03.2024 in W.P. No. 3147 of 2021 by the respondents.
2. An order has been passed to allow the petitioner to receive his retirement benefits and pension without any reduction in respect of back wages and now the petitioner has raised a grievance saying that a reduction has been made towards the loan availed by him.
3. It is the submission of the petitioner that he has already repaid the loan amount and that the final settlement was made in the year 1995, after deducting the amount payable by him towards the pending loan.
4. While passing the orders in the writ petition on 18.03.2024, the focus was only with regard to the relief sought by the petitioner for revision of his pensionary entitlements along with retirement benefits. Even now, the respondents have not denied the retirement benefits and the order has been complied with in its true letter and spirit. If there is any difference with regard to the deduction towards the loan amount availed 2/4
by the petitioner, the same can be worked out by the petitioner by filing a computation petition before the Labour Court and agitate the issue therein.
5. As the order has been complied within its scope and is commensurates with the relief sought and granted, there is no need to keep the contempt proceedings pending.
