Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Declaration, declaring the action of the respondents in denying the petitioner eligibility to participate in the Inter-Directorate General Transfer counselling for the years 2024-2025 and 2025-2026 as arbitrary, illegal and unsustainable in law; consequentially, direct the respondents to permit the petitioner to participate in the said Transfer counselling for the year 2025-2026 and to consider his request for transfer to Thanjavur Medical College Hospital or any other suitable vacancy within a time frame to be stipulated by this Hon'ble Court. 1/5

ORDER
This Writ petition has been filed seeking to declare the action of the respondents in denying the petitioner's eligibility to participate in the InterDirectorate General Transfer counselling for the years 2024-2025 and 20252026 as arbitrary, illegal and unsustainable in law and to consequently, direct the respondents to permit the petitioner to participate in the said Transfer counselling for the year 2025-2026 and also to consider the petitioner's request for transfer to Thanjavur Medical College Hospital or any other suitable vacancy.

When the matter was taken up for hearing, Mr.M.Bindran, learned Additional Government Pleader appearing on behalf of the respondents submitted that, pending Writ petition, the petitioner has been permitted to participate in the counselling. Learned counsel for the petitioner also ratifies the above said submission of the learned Additional Government Pleader. 2/5
3. Learned Additional Government Pleader has also produced a communication dated 19.09.2025 issued by the 1st respondent before this Court.

For the sake of convenience, the relevant potion of the said communication issued by the Director of Medical and Rural Health Services is extracted hereunder :- "Willingness has been called for from the pharmacist for inter directorate transfer counselling who is working under the control of all directorates (DMS, DME, DPH, DMS(ESI) vide this office ref. No. 14893/F5(1)/2/2025 dated: 15.09.2025. Accordingly service particular has to be submitted by all directorates.
Based on the particulars received from all other directorates and as per the service seniority list to be prepared for transfer counselling.
In this regard, it is submitted that The Petitioner is working cs pharmacist at Government Primary Health Centre, Koodacheri, Namakkal District which comes under the control of Directorate of public health and preventive medicine. Hence based on the particulars received from DPH, the petitioner to be permit to participate in the said Transfer Counselling for the 3/5
year 2025-26 and to consider his request for transfer to Thanjavur Medical College Hospital or any other suitable vacancy depend upon his seniority."
5. In view of the above, this Court is of the view that, no further adjudication is required in this Writ petition and accordingly, this Writ Petition stands closed. No costs.
