O R D E R

The petitioner, who was arrested and remanded to judicial custody on 18.02.2025, pursuant to a non-bailable warrant issued in C.C.No.147 of 2018 on the file of Judicial Magistrate No.II, Krishnagiri, in Crime No. 405 of 2018 for the offences punishable under Section 392 of IPC, on the file of 1/6

respondent police, seeks bail.

2. The case of the prosecution is that due to non-appearance before the Trial Court on 13.02.2020, NBW was issued against the petitioner on 13.02.2020 and the same was executed on 07.03.2025. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is no way connected with the alleged offence however, he is suffering incarceration from 18.02.2025. He also submits that due to health related issues, he could not appear before the Trial Court, thereby the trial court issued a NBW against him. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that this is a second bail application and this Court, by order dated 28.07.2025, dismissed the earlier bail petition in Crl.O.P.No.20968 of 2025 taking note of the antecedent of the petitioner. He submits that NBW was issued against the petitioner on 13.02.2020 and the same was executed on 07.03.2025 after a 2/6

period of five years. He also submits that 25 previous cases were pending against the petitioner. Hence, he strongly opposed to grant bail to the petitioner.

5. Considering the above facts and circumstances of the case , taking note of the submission made by the learned Government Advocate (Criminal Side), taking into account that twenty five previous cases were pending against the petitioner, this Court is not inclined to grant bail to the petitioner.
