O R D E R

The petitioner, who was arrested and remanded to judicial custody on 15.04.2025, for the offences punishable under Sections 147, 148, 294(b), 450, 427, 302, 506(ii) r/w 149 r/w 109 of IPC, 1860 in P.R.C.No.66 of 2024 on the file of XVMM Court, George Town, Chennai, seeks bail. 1/6

2. The case of the prosecution is that due to non-appearance before the Trial Court on 23.01.2025, NBW was issued against the petitioner on 23.01.2025 and the same was executed on 15.04.2025. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is no way connected with the alleged offence however, he is suffering incarceration from 15.04.2025. He further submits that due to his detention on another case, he could not appear before the Trial Court on 23.01.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and submits that this is a second bail application and this Court, by order dated 13.08.2025, dismissed the earlier bail petition in Crl.O.P.No.18257 of 2025 for the reason that the case is at PRC stage due to the repeated absence of the accused persons. He further submits that there are totally 10 accused in this case and the petitioner is arrayed as A10. Now, the case is at PRC stage and there is no 2/6

change of circumstances in this case. Hence, he strongly opposed to grant bail to the petitioner.

Considering the above facts and circumstances of the case , taking note of the submission made by the learned Government Advocate (Criminal Side), considering the fact that this is a 2nd bail application and there is no change of circumstances in this case, this Court is not inclined to grant bail to the petitioner.
