ORDER
This Criminal Original Petition has been filed seeking to enlarge the petitioner on Anticipatory Bail in the event of arrest in Crime No. 256 of 2024 pending on the file of the respondent Police. 2.
When the matter came up for hearing on 12.11.2024, it was informed by the learned Government Advocate that the petitioner herein has got 14 previous cases and that an earlier application filed by the very same Counsels in Crl.O.P.No.28178 of 2024 was dismissed as withdrawn. On 12.11.2024, the second application has been filed by the very same Counsels, suppressing the dismissal of the earlier application by this Court. This Court directed the Counsels to state the reasons under what circumstances the second application has been filed. 3.
Mr.G.Selva Balaji, learned representing Counsel submits that all of them are young advocates and they were enrolled very recently and they have done the same without understanding the consequences. The young advocates apologized for having done the same and they have also 2/4
filed their Affidavits of Undertaking before this Court. 4.
Taking into consideration the above and the future of the young advocates, this Court does not want to take any further action against them. However, the affidavits of apology filed by the young Advocates are directed to be kept in a sealed cover before the Registry. It is also submitted by the learned Government Advocate that the petitioner in this case has been arrested and remanded to judicial custody and hence, this Criminal Original Petition has become also infructuous. 5.
Recording the above, this Criminal Original Petition is dismissed as infructuous.
11.12.2024 MSM Note: Registry is directed to keep the bundle and the affidavits in a sealed cover. The learned Counsels would also submit that the similar thing will not happen in future "by way of their undertaking affidavit"
