Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to pass an order on petitioner's appeal dated 16.05.2022 to issue Patta for the remaining extent of 1000 sq.ft comprised in Patta No.8994, 1/6

With consent, the main Writ Petition is taken up for final disposal at the stage of admission itself.

The petitioner has filed this Writ Petition praying for the issuance of a mandamus on the 2nd respondent to pass orders on his Appeal dated 16.05.2022 to issue Patta for the remaining extent of 1000 sq.ft comprised in Patta No.8994, S.No.44/23 1A1B Puthagaram Village, Madhavaram Taluk, Chennai District based on the recommendation of the revenue officials and as per registered sale deed.

The learned counsel for the petitioner would submit that initially, the petitioner approached the third respondent for issuance of patta in respect of a property, (morefully described in para No.2 of this order) measuring an total extent of 2400 sq.ft; that the third respondent issued patta only for 1400 sq.ft., and failed to grant patta for remaining 1000 sq.ft. extent of land, hence, the petitioner approached the third respondent for granting patta in respect of the remaining extent of land, however the third respondent rejected the said request vide order dated 16.04.
2022, on the ground that the the petitioner's land was acquired by the fourth respondent for Metropolitan Waterway Project; that aggrieved by such rejection, the petitioner filed an Appeal before the second respondent, who in turn, directed the other revenue officials, viz. VAO, Tahsildar and Special Tahsildar to conduct an enquiry and survey the petitioner's land and submit a report, pursuant to which, the aforesaid Officials also verified the petitioner's property and filed a report, recommending for alteration of the petitioner's patta by adding 1000 sq.ft.
petitioner has approached this Court, by way of filing this Writ Petition, seeking for the aforementioned relief. It is further submitted that the petitioner would be satisfied, if a direction is issued to respondent No.2 to dispose of the Appeal pending before him within a stipulated time.
4. The learned Government Advocate for the respondents would submit that the appeal filed by the petitioner would be considered and disposed of in accordance with law within the time frame that may be stipulated by this Court.

Considering the aforesaid submissions and the limited scope of the prayer, sought for by the petitioner, in this Writ Petition, this Court, without expressing any view with regard to the merits of the contentions putforth by the petitioner either in the Writ Petition or in the Appeal, is of the view that, suffice it would be to direct the second respondent to consider and dispose of the petitioner's Appeal in a time bound manner. 4/6

Accordingly, the Writ Petition is disposed of with a direction to the second respondent to consider the Appeal made by the petitioner dated 16.05.2022 and dispose of the same as early as possible, preferably, within a period of six weeks from the date of receipt of a copy of this order based on the recommendation made by the revenue officials and communicate the decision taken to the petitioner. No costs.
