N.Thanabal v. Marathon Electric India Private Limited

This application has been filed by the applicant/proposed plaintiff to substitute the name of the plaintiff as N.Thanabal instead of Marathaon Electric India Private Limited and to remove the name of the 1st respondent/plaintiff as per the Assignment Agreement dated 24.09.2023 pending disposal of the above suit.

2. The learned counsel for the respondents 2 & 3 /defendants 1 & 2 has no objection in allowing this application.

3. Being satisfied with the reasons stated in the affidavit filed in support of the application, this application is allowed.

4. Learned counsel for the proposed plaintiff is directed to carry out necessary amendment.

5. Registry is directed to remove the name of plaintiff namely, Marathon Electric India Private Limited and their counsel name M/s.Surana and Surana from the cause list and post on 08.01.2024.
