Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondents to grant promotion to the petitioner to the post of Assistant Commissioner in the skipped panel years namely 2021-22 or 2022-23, with all attendant and consequential benefits, including service promotion and other terminal benefits.

ORDER
This Writ Petition is filed for issuance of a writ of mandamus, directing the respondents to grant promotion to the petitioner to the post of Assistant Commissioner in the skipped panel years namely 2021-22 or 202223, with all attendant and consequential benefits, including service promotion and other terminal benefits.
2. The case of the petitioner is that he was initially appointed as Junior Assistant in the respondent Department on 24.02.1993 and later promoted as Assistant in the year 2004 and further as Superintendent on 30.06.2020. Thereafter, he retired from service on 30.06.2024, on attaining the age of superannuation. His grievance is that his promotion to the post of Assistant Commissioner was prejudiced owing to the fact that no panel was constituted for the periods 2021-22 and 2022-23. Subsequently, panel for the year 2023-24 alone was formed and the vacancies that had arisen over the three year period between 2021 and 2024 were sought to be filled based solely on the eligibility criteria applicable to the panel year 2023-24. The said action of the respondents had adversely impacted the promotional prospects of the petitioner. In this regard, he submitted a representation to the respondents on 25.09.2024 but the same has not been considered. Hence, he has come before
this Court by way of this Writ Petition.
3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.
4. Taking into consideration the facts and circumstances of the case, the second respondent is directed to consider the representation of the petitioner, dated 25.09.2024, and pass appropriate orders on merit and in accordance with law, within a period of eight weeks from the date of receipt of copy of this order. It is made clear that this Court has not made any observation with regard to merit or claim of the petitioner.
5. Writ Petition is disposed of accordingly. No costs. 22.09.2025 NCC :
